Terms and Conditions of Participation – FC Bayern Raffle 2025

Einhell Germany AG, Wiesenweg 22, 94405 Landau/Isar (hereinafter referred to as “Einhell Germany AG” or the “Organiser”), is running the “FC Bayern Prize Draw” (hereinafter referred to as the “Promotion”).

Consumers who purchase a Power X-Change product between 01/05/2025 and 14/05/2025 will have the chance to win the following prize:
1x jersey in size L (signed, team).

Only natural persons who are at least 18 years of age and have a place of residence in Germany or Austria are eligible to participate in the Promotion. Each person may enter the raffle only once. Participation in the raffle organised by Einhell Germany AG is possible exclusively online via www.einhell.de or www.einhell.at and must be in the participant’s own name. A mobile or stationary internet connection (Wi-Fi) is required. Additional provider-dependent charges may apply. Employees of the Organiser and their relatives, as well as employees and relatives of companies affiliated with the Organiser and cooperation partners, are not eligible to participate.
To take part, participants must provide all required personal information in full. Winners will be drawn at random. Participation via entry or raffle registration services is excluded. A cash payment of the prize is not possible. Prizes may not be exchanged for other services, nor transferred or assigned to third parties.

Participation is possible until 14 May 2025, 11:59 p.m. (German time) (“entry deadline”). Unfortunately, late entries cannot be considered, regardless of the reason.

To take part in the Promotion, participants must complete the following steps between 1 May 2025 and 14 May 2025:

• Purchase a Power X-Change product via einhell.de during the period from 01/05 to 14/05/2025.
• For prize delivery, the participant must provide and submit their full and accurate details at the time of purchase, including surname, first name, postcode, town/city, street, house number, telephone number and email address. The telephone number is required solely for scheduling the delivery.

The winner will be determined on 16/06/2025 and contacted thereafter.
The main prize will be dispatched approximately one month after the draw.

Participants are solely responsible for the accuracy of the email address, telephone number, and delivery address they provide. The right to claim the prize will lapse if delivery cannot be made within 7 working days of the initial prize notification due to reasons attributable to the winner.

The Organiser reserves the right to exclude any participants from the Promotion who provide false information, violate the terms and conditions, and/or engage in or facilitate manipulation. The Organiser also reserves the right to exclude individuals suspected of using unauthorised aids or otherwise attempting to gain an advantage for themselves or others through manipulation. In such cases, the Organiser may refuse to award a prize that has already been promised and may also demand the return of a prize already issued. Participation on behalf of a third party is not permitted. Multiple entries are allowed.

Einhell Germany AG reserves the right to cancel, shorten, postpone and/or modify the raffle at any time without prior notice and without stating reasons, if circumstances require it at the sole discretion of Einhell Germany AG. This applies in particular if the proper conduct of the raffle can no longer be guaranteed for technical reasons (e.g. viruses in the computer system, manipulation or faults in hardware and/or software) or for legal reasons. If such termination is caused by the behaviour of a participant, Einhell Germany AG reserves the right to claim compensation for any resulting damages from that individual.

The Organiser shall be liable in accordance with statutory provisions for its own intent and gross negligence, as well as that of its legal representatives, senior executives or other vicarious agents. The same applies in cases of the assumption of guarantees or other strict liability, and in the event of claims under the Product Liability Act or culpable injury to life, limb or health. The Organiser shall be liable, in principle, for damage caused by the simple negligence of itself, its legal representatives, senior executives or ordinary vicarious agents only in the event of a breach of essential contractual obligations – i.e. obligations whose fulfilment participants could regularly rely upon for the proper execution of the raffle. In such cases, liability shall be limited to foreseeable damages typical of this type of contract. Any liability beyond this is excluded.

• Data processing in connection with participation in the Promotion:
  Detailed information on the processing of personal data in connection with the Promotion can be found in the Privacy Policy regarding the “FC Bayern Raffle”.
• Data processing in connection with use of the raffle website:
  Information on data collected during the use of the raffle website is described in the Privacy Policy.
• Processing is carried out based on Article 6(1)(a) of the GDPR for the purpose of conducting the raffle. The following data is collected:
  Name, address, email address, date of birth.
• All data will be deleted no later than six months after the end of the raffle.

All legal relations between participants and Einhell Germany AG shall be governed exclusively by the laws of the Federal Republic of Germany. Legal recourse is excluded. This does not apply in relation to matters concerning data protection law.

These terms and conditions constitute the final and complete rules for the raffle. Should any provision of these terms and conditions be or become invalid, or should there be a gap in the regulations, the validity of the remaining provisions shall remain unaffected. Any invalid or incomplete provision shall be replaced or supplemented by a provision that most closely reflects the interests of the Organiser and the parties involved, unless otherwise individually agreed between the parties.
